Pension fund notification conditions require foreign regulation, limited asset use, quarterly investment reporting, and compliance certification. A pension fund covered by Schedule V must satisfy specified conditions to qualify for notification. The fund must be regulated under the law of a foreign country, administer or invest assets for retirement, social security, employment, disability, death benefits or similar compensation plans, and use its earnings and assets only for those statutory obligations and defined contributions. The rule permits limited asset administration where the value does not exceed 10% of total assets, the assets are wholly owned by a foreign government, and vest in that government on dissolution. It also preserves use of earnings from such assets where credited to a foreign government account or another designated account so that no private person benefits.
