Rule 17: Retirement Benefits for Tribunal Members, Election Option for Pension or Provident Fund within Three Months.
Rule 17 of the CESTAT members (Recruitment and Conditions of Service) Rules, 1987 outlines retirement benefits for tribunal members. Members holding a pensionable government post at the time of appointment are eligible for a pension under applicable retirement rules. Others are entitled to Contributory Provident Fund benefits, with an option to elect for pensionary benefits within three months of substantive appointment. Failure to communicate this choice defaults to Provident Fund benefits. Direct recruits from the bar may add qualifying service for a superannuation pension under specific conditions, provided their qualifying service is at least ten years.
