Declaration of financial or other interest for Chairperson and Members requires FormIII disclosure and Central Government satisfaction before appointment.
Appointees as Chairperson or Member under the NCLAT Rules, 2015 must submit a FormIII declaration of financial and other interests, declaring absence of any interest likely to prejudicially affect their functions; the declaration must satisfy the Central Government and is a precondition of appointment. The rule prescribes preventive disclosure to manage conflicts of interest and makes Central Government satisfaction the operative compliance standard; failure to provide a satisfactory declaration would operate as noncompliance with appointment conditions and impede assumption of office.
