Leave entitlements for Chairperson and Members under NCLAT Rules: 30 days earned leave yearly, encashment subject to CCS limits.
Chairperson and other Members are entitled to thirty days of earned leave for each year of service; payment during leave follows rule 40 of the Central Civil Services (Leave) Rules, 1972, thereby tying leave salary entitlement to that statutory framework. Encashment of earned leave is permitted but is subject to the maximum aggregate limit prescribed under the Central Civil Service (Leave) Rules, 1972, and includes amounts previously received at retirement from earlier service; consequence: encashment cannot exceed the prescribed statutory ceiling regardless of accumulated credited leave.
