      Amendment in Policy for General Authorisation for Export of Chemicals and related Equipments (GAEC) - Paragraph 10.08 (ix) in the Foreign Trade Policy 2023 amended
      Summary: The amendment replaces country specific listings in Para 10.08(ix) with a reference to Paragraph 10.16 of the Handbook of Procedures 2023 for determining eligible destination countries under the General Authorization for Export of Chemicals and related equipments (GAEC). GAEC remains a one time DGFT authorization with fixed term validity and is subject to mandatory post export reporting of all exports effected under the authorization.

      Corporate Debt Market Development Fund - Net set of regulations in respect of Alternative Investment Fund set up and making investments, notified - Securities and Exchange Board of India (Alternative Investment Funds) (Second Amendment) Regulations, 2023
      Summary: The Securities and Exchange Board of India has added a new specified AIF category, the Corporate Debt Market Development Fund (CDMDF), a close ended trust that purchases eligible corporate debt from specified debt oriented mutual fund schemes during market dislocation. CDMDF investments must meet eligibility criteria, be purchased proportionally and at fair prices, observe issuer and group exposure caps, and follow prescribed valuation norms. The regime mandates trustee appointment, a Governance Committee, frequent portfolio and NAV disclosures, prohibition on listing units, a liquidation scheme framework for illiquid assets, Manager continuing interest, and Compliance Officer requirements.

      Amendment in Paragraph 10.16 (A) in the Handbook of Procedures 2023 to amend the procedure for General Authorisation for Export of Chemicals and related Equipments (GAEC).
      Summary: The amendment expands the General Authorisation for Export of Chemicals and related Equipment (GAEC) to include specified chemicals listed in Appendix 10(N) and their export/re export to listed countries, requiring a one time online GAEC application via the SCOMET portal with ANF 10A. Exports under GAEC are subject to civilian use restrictions, exporter declarations on letterhead covering end use and supply chain transfers, a five year GAEC validity, and mandatory quarterly post reporting to government authorities.

      Public Notice No. 42/2023 - dated 17-5-2023
      Procedure for clearance of import cargo categorized as “hazardous”goods reg.
      Summary: For imported hazardous goods, Classes 5, 8 and 9 require a cargo analysis report or Material Safety Data Sheet and limited examination at authorised CFSs under importer supplied trained supervision. Other higher risk classes must be scanned at the JNCH scanning site; opening on the yard is disfavoured and such containers may be provisionally allowed OOC only after a certified clean stamp on the movement slip. Containers marked suspicious may be released provisionally for factory examination under Customs supervision on submission of a no use bond, transported under Customs seal, with seizure and referral to investigation if tampering or contraventions are found.

      Modification in the procedure of granting manual Out Of Charge-reg.
      Summary: Manual Out Of Charge will be issued only with prior approval of the concerned Commissioner of Customs at JNCH after resumption of the Electronic Cash Ledger; all other procedural requirements of the earlier Public Notice remain in force and must be followed; a Nodal Officer and commissionerate email contacts are provided for implementation issues.

      Addendum to Public Notice No. 28/2023 dated 06.04.2023.
      Summary: Where an importer cannot produce the bank certificate due to bank closures, the Additional/Joint Commissioner in-charge of the Docks or RMS FC may, on a case-by-case basis and upon proof of payment of duty, permit grant of Out Of Charge for the consignments, subject to the importer submitting an undertaking to provide the bank certificate by the prescribed deadline, and provided the officer is satisfied that duty appears to have been paid.
