Priority Rules for Pre-packaged Resolution and CIRP Applications under Sections 54C and 11A Explained
Applications under section 54C (Pre-packaged Resolution) and sections 7, 9, or 10 of the Corporate Insolvency Resolution Process (CIRP) are addressed by the Adjudicating Authority as per Section 11A. If a section 54C application is pending, it must be resolved before any other applications concerning the same debtor. If filed within 14 days of a CIRP application, the section 54C application is prioritized. If filed after 14 days, the CIRP application takes precedence. Section 11A does not apply if a CIRP application was pending before the 2021 amendment ordinance.
