Section 30 of Limitation Act, 1963: Transition Rules for Filing Suits and Appeals from 1908 Act Explained.
Section 30 of the Limitation Act, 1963, addresses the transition of limitation periods from the Indian Limitation Act, 1908. It permits the filing of suits with shorter limitation periods under the new Act within seven years of its commencement or within the period prescribed by the 1908 Act, whichever is earlier. If the seven-year period ends before the limitation period under the 1908 Act, and this combined period is shorter than that under the new Act, the suit can be filed within the new Act's limitation period. Appeals or applications with shorter periods can be filed within ninety days of the new Act's commencement or as per the 1908 Act, whichever is earlier.
