Understanding Section 16: Limitation Periods and Legal Representatives After Death
Section 16 of the Limitation Act, 1963, addresses the effect of a person's death on the accrual of the right to sue. If a person who could have initiated a suit or application dies before the right accrues, or if the right arises upon their death, the limitation period starts when a legal representative is available. Similarly, if a person against whom a suit could be filed dies before the right accrues, the limitation period begins when a legal representative is available. This section does not apply to suits regarding pre-emption rights or possession of immovable property or hereditary offices.
