Special Bench reference requires constitution of an expanded bench to reconsider and determine questions of law. When a Bench encountering a question of law previously decided by another Bench deems that question requires reconsideration, it must refer the matter to the Chairperson, who shall constitute a Special Bench of five Members to hear and decide the question of law.
