Transfer of winding up proceedings: pending cases may be moved to the Tribunal for initiation of corporate insolvency resolution. The amendment permits any party to winding up proceedings pending in Court immediately before the Insolvency and Bankruptcy Code (Amendment) Ordinance, 2018 to apply for transfer of those proceedings to the Tribunal; the Court may order the transfer and the Tribunal must treat the transferred proceedings as an application for initiation of the Corporate Insolvency Resolution Process under the Insolvency and Bankruptcy Code, 2016.
