India-ASEAN Trade Rules: Central Government May Adjust Customs Duties to Prevent Serious Injury Under Rule 11
Rule 11 of the India-ASEAN Trade in Goods Agreement (Safeguard Measures) Rules, 2016, outlines the application of safeguard measures by the Central Government. Upon recommendation from the Director General, the government may amend customs notifications to prevent or remedy serious injury by either suspending further customs duty reductions or increasing the duty rate, not exceeding the Most Favoured Nation rate. Safeguard measures cannot be imposed on goods already subject to actions under the Customs Tariff Act, 1975. If the Director General's final findings do not support safeguard measures, any provisional measures must be withdrawn within thirty days.
