Safeguard measures: central government may amend customs notifications to suspend tariff reductions or increase duty.
On the Director General's recommendation, the Central Government may amend customs notifications to suspend tariff reductions or increase customs duty for goods covered by final findings, subject to a ceiling equal to the lesser of the Most Favoured Nation applied rate at the time of the safeguard or that in effect immediately before the Trade Agreement's entry into force. Measures under these rules cannot apply to goods already subject to actions under section 8B of the Customs Tariff Act, 1975, and any provisional safeguards must be withdrawn within thirty days if the final finding contains no recommendation.
