Finance Bill 2020: Expanding Eligibility for Adjudicating Authority to Include District Judge Qualified Individuals u/s 9.

The Finance Bill 2020 proposes to amend section 9 of the Prohibition of Benami Property Transaction Act, 1988, to expand the eligibility criteria for appointing members of the Adjudicating Authority. Currently, eligibility is limited to members of the Indian Revenue Service who have served as Commissioners of Income-tax or equivalent, and members of the Indian Legal Service who have held the post of Joint Secretary or equivalent. The amendment will include individuals qualified for appointment as District Judges. This change is set to take effect from April 1, 2020.
