      Summary: The amendment to Chapter 27 of ITC(HS) records kerosene and LPG as freely exportable while maintaining a general requirement for a Ministry of Petroleum & Natural Gas NOC, and provides that exports of kerosene and LPG to Nepal and Bhutan by Indian Oil Corporation Ltd are exempted from that NOC requirement.

      Summary: The circular grants a time bound relaxation permitting omission of Block R10 in Form 1 until specified extended dates for the 2nd quarter 2013 14 (with penalty thereafter) and makes R3 tax contribution in Form DVAT 16 non mandatory for that quarter only. The notification amends the Central Sales Tax (Delhi) Rules, 2005 by substituting the receipt procedure requiring Form DVAT 56 and replacing Form 1 with a revised return format that details turnover, deductions, tax computation, adjustments, deposit proof requirements and verification.

      Clarifications for filing returns online.
      Summary: Clarifications require dealers to supply details of pending statutory forms and to report tax-rate-wise turn over and exempted turnover in amended online VAT return blocks; transitional non mandatory treatment is allowed for specified tax rate fields for the second quarter only, after which such fields become mandatory. Dealers may regularise missing forms by payment with interest and enter such information in the return block, and submitted pending form details will auto reflect in future returns.

      Summary: Transfers of shares in financial sector investee companies from residents to non residents no longer require filing of No Objection Certificate (NoC) with form FC TRS under the Foreign Exchange Management regime; however, any fit and proper/due diligence requirements imposed by the sectoral regulator for the non resident investor must still be observed and complied with.

      Summary: Authorisations such as Advance Authorisation and Duty Free Import Authorisation must be used only for import of gold intended for export; diversion for domestic use is prohibited. Sequencing of imports prior to exports will not be insisted upon for authorisations issued before 14 August 2013. SEZ and EoU units and Premier and Star Trading Houses may import gold exclusively for export. Exports fulfilling AA/DFIA obligations do not qualify for the 20:80 scheme. Directions are issued under FEMA.

      Foreign investment in India - participation by SEBI registered FIIs, QFIs and SEBI registered long term investors in credit enhanced bonds
      Summary: SEBI-registered FIIs, QFIs and SEBI-registered long-term investors are permitted to invest on a repatriation basis in domestic credit-enhanced bonds issued under the ECB policy, subject to the eligibility, structural and operational conditions for credit enhancement set out in the relevant ECB circulars, and within the aggregate corporate debt investment ceiling; Category-I Authorised Dealer banks must inform their constituents, and the directions are issued under the foreign exchange regulatory statute without affecting other required permissions.

      Enhancement in registered quantity for export of sugar

Applications must be filed through the mandated online system in accordance with the applicable Trade Notice, and exporters must continue to follow the existing procedural modalities and documentation requirements for contract registration.

M/s Indian Sugar Exim Corporation Limited is the designated export agency. Exports must be accompanied by a certificate of origin issued in accordance with Articles 55-65 of Regulation (EEC) No. 2454/93 as required by Article 10 of Regulation (EC) No. 891/2009, with the specified CXL wording on export authorizations. The GSP Certificate and Certificate of Origin are to be issued by the Additional Director General of Foreign Trade, Mumbai, and the EUR form endorsed by Customs at the port.
