      Summary: Invoice value declared by a supplier of import of services between related persons shall be deemed the open market value under the second proviso to rule 28(1) of the CGST Rules when the recipient is eligible for full ITC; absent an invoice from HO or related domestic entity the value may be treated as nil and thus deemed open market value. For RCM supplies from unregistered persons, the financial year for ITC under Section 16(4) is the year the recipient issues the invoice, subject to tax payment and other conditions. Where credit notes are issued post-supply, recipient-issued certificates or undertakings evidencing reversal of ITC (including CA/CMA certificates with UDIN where applicable) are acceptable until portal functionality is available.

      Securities and Exchange Board of India (Credit Rating Agencies) (Amendment) Regulations, 2024.
      Summary: Amendment replaces clause (i) in the Explanation to regulation 28B(1)(d) to define "liquid asset" as a low risk asset readily convertible to cash, including cash; units of overnight or liquid mutual fund schemes; fixed deposits of scheduled commercial banks; government securities; treasury bills; repo on government securities; and repo on corporate bonds. The amendment is effected under section 30 read with section 11 of the SEBI Act and commences on publication in the Official Gazette.

      Securities and Exchange Board of India (Issue and Listing of Non-Convertible Securities) (Amendment) Regulations, 2024
      Summary: The amendment mandates a record date fixed fifteen days before payment or corporate action dates and replaces due diligence provisions to require debenture trustees to furnish specified due diligence certificates at the draft-offer stage and at filing of the listing application, with distinct formats for secured and unsecured debt. Stock exchanges must disclose offer documents, placement memoranda and the debenture trustee's certificates. Schedule changes permit listed issuers to use a web-link/QR for audited financials subject to certified comparative disclosures and require trustee confirmations on security, covenants, debenture trust deed execution and charge registration.

      Mechanism for providing evidence of compliance of conditions of Section 15(3)(b)(ii) of the CGST Act, 2017 by the suppliers
      Summary: Where portal verification of proportionate reversal of input tax credit for post-supply discounts via tax credit notes is unavailable, the supplier may obtain a CA/CMA certificate from the recipient certifying reversal, specifying credit note and invoice details, ITC reversal amounts and the documentary route (e.g., FORM GST DRC-03 or returns), and containing a UDIN; for smaller aggregate tax amounts an undertaking from the recipient with the same particulars is acceptable. Such certificates/undertakings constitute admissible evidence of compliance and must be produced to tax authorities when required.

      Clarification on time limit under Section 16(4) of CGST Act, 2017 in respect of RCM supplies received from unregistered persons
      Summary: Clarifies that for supplies from unregistered persons where tax is payable by the recipient under the reverse charge mechanism, the registered recipient must issue the invoice and pay tax; the relevant financial year for the time limit to avail input tax credit is the financial year in which that recipient-issued invoice is issued, subject to payment of tax and other statutory conditions. Delayed issuance after time of supply attracts interest and possible penal consequences.

      Clarification on valuation of supply of import of services by a related person where recipient is eligible to full input tax credit
      Summary: Where a recipient of imported services from a related foreign person is eligible for full input tax credit, the value declared in the invoice by the recipient shall be deemed to be the open market value of those services. The recipient must pay tax under the reverse charge mechanism and issue a self-invoice; if no invoice is issued by the recipient for particular services, the recipient may deem the value as Nil, which shall be treated as the open market value for valuation purposes.

      Clarification on the provisions of clause (ca) of Section 10(1) of the Integrated Goods and Service Tax Act, 2017 relating to place of supply of goods to unregistered persons
      Summary: For supplies of goods to unregistered persons the place of supply is the location as per the recipient's address recorded in the invoice, and where no such address is recorded the supplier's location applies; recording the recipient's State on the invoice is deemed to be recording the address. Where billing and delivery addresses differ on the invoice, the place of supply is the delivery address, and suppliers may record the delivery address as the recipient's address for this purpose.

      Guidelines for recovery of outstanding dues, in cases wherein first appeal has been disposed of, till Appellate Tribunal comes into operation.
      Summary: If the Appellate Tribunal is not operational, taxpayers can secure a stay of recovery by paying an amount equal to the pre-deposit via Services Ledgers Payment towards demand, which maps the payment in Electronic Liability Register Part II against the selected order, and by filing an undertaking to appeal before the Tribunal when it is constituted. Payments inadvertently made through FORM GST DRC-03 can be adjusted towards the pre-deposit upon filing FORM GST DRC-03A (subject to exclusions where FORM GST DRC-05 has been issued); absence of payment, undertaking, or timely DRC-03A filing permits recovery under the CGST Act.

      Clarification on various issues pertaining to taxability and valuation of supply of services of providing corporate guarantee between related persons.
      Summary: The provision of corporate guarantees between related persons to banks or financial institutions is taxable and, for guarantees issued or renewed on or after 26 October 2023, valuation is governed by Rule 28(2). The value equals the higher of actual consideration and one per cent per annum of the amount guaranteed (pro rata for periods under a year and multiplied by years for multi year guarantees). Tax is payable on issuance and on each renewal; domestic intra group guarantees are forward charged with invoicing, foreign issued guarantees to Indian recipients attract reverse charge, and recipients may claim input tax credit subject to conditions.

      Mechanism for refund of additional Integrated Tax (IGST) paid on account of upward revision in price of the goods subsequent to exports
      Summary: Refunds of additional IGST paid due to upward post-export price revisions are claimable by exporters via FORM GST RFD-01 filed electronically; jurisdictional GST officers will process such claims under rule 89 using GSTN-provided shipping bill and IGST data. Claims require specified documentary proof-shipping bills, original and revised invoices or debit notes, contract evidence, proof of additional IGST and interest payment, foreign exchange remittance (FIRC) and a practising accountant's certificate-and the officer must verify reporting in FORM GSTR-1 and FORM GSTR-3B before issuing a speaking sanction and payment order.

      Processing of refund applications filed by Canteen Stores Department (CSD)
      Summary: CSDs must file refund claims electronically in FORM GST RFD-10A on the common portal, applying quarterly (with an option to club quarters/FYs). Refunds are admissible only for inward supplies received from registered suppliers who have furnished GSTR-1 and filed GSTR-3B; invoices must show supplier GSTIN and CSD GSTIN and be accompanied by an undertaking and declaration. The proper officer will validate invoices against GSTR-2B/GSTR-1/GSTR-3B, exclude already-refunded invoices, ensure a partial tax refund cap, verify ITC reversals, and issue orders in FORM GST RFD-06 with a speaking order.

      Summary: A new ICEGATE utility standardises the Voyage Call Number (VCN) format for uniform rotation number generation under SCMTR: VCN must be 14 characters comprising last four of port code, four digit year, two digit month, and last four of the running serial number; non NLP ports must supply only the last four digits of long serials or prefix zeroes if shorter. NLP transmission remains primary but the utility may be used when NLP data is not received; the system issues a single rotation number and displays it if already generated.
