Suits not to abate: civil actions continue despite death or cessation, proceeding in the name of the successor. Civil proceedings do not abate or discontinue because the person by or against whom the suit was brought dies or ceases to hold the character in whose name they were sued; the suit or proceeding is to be continued in the name of or against that person's successor, preserving continuity of prosecution or defence.
