<h1>Retail sale price fixing for notified goods with missing or tampered labels, using market surveys and highest RSP rule</h1> Prescribes the method for ascertaining the retail sale price (RSP) of notified goods removed without proper declaration of RSP, or where the declared RSP is obliterated or tampered. If identical goods were manufactured and removed within one month before or after such removal with a declared RSP, that declared RSP is adopted, thereby fixing the RSP for the non-compliant clearances. If not ascertainable, RSP is determined through sample-based retail market inquiries of similar goods sold at about the time of removal, thereby enabling assessment on a market-derived RSP. Where post-removal tampering increases RSP, the increased RSP applies to all goods removed during one month before and after the relevant removal, and in cases of multiple ascertained prices, the highest RSP is applied to all such goods.
