New LLP Act Sections 67A-C: Special Courts for Fast-Track Trials, Summary Procedures, and High Court Oversight
The Limited Liability Partnership (Amendment) Act, 2021 introduces sections 67A, 67B, and 67C to establish Special Courts for the speedy trial of offences under the Act. Section 67A allows the Central Government to designate Special Courts, comprising a Sessions Judge for serious offences and a Magistrate for others, until which existing Special Courts under the Companies Act serve this role. Section 67B outlines the procedure and powers of Special Courts, permitting summary trials for offences with imprisonment up to three years. Section 67C grants High Courts appellate and revisionary powers over Special Court decisions, treating them akin to Court of Sessions.
