Amendment to LLP Act 2021: Section 39 Updated for Offence Compounding; New Rules on Repeat Offences and Fines
The Limited Liability Partnership (Amendment) Act, 2021, replaces section 39 with provisions for compounding offences under the Act. The Regional Director or authorized officer can compound offences punishable by fines, collecting amounts within the specified range. This does not apply to repeat offences within three years. Applications for compounding are submitted to the Registrar, who forwards them to the appropriate authority. If compounded before prosecution, no prosecution will occur; if after, the court is notified for discharge. The authority may direct compliance with filing requirements, and non-compliance may result in doubled fines.
