of <h1>Procedure for 2020 Rules inquiry into alleged NCLT/NCLAT member misconduct or incapacity: flexible process, guided by natural justice</h1> The Judge conducting an inquiry under the 2020 Rules into alleged misbehavior or incapacity of the Chairperson, President, or other Members of the NCLT/NCLAT is not bound by the procedure prescribed in the Code of Civil Procedure, 1908, but must be guided by the principles of natural justice. The Judge is empowered to regulate the inquiry procedure, including determining the places and times at which the inquiry will be held, thereby enabling a flexible, self-directed process subject to natural justice requirements.
