<h1>Investigation rules for NCLT/NCLAT members' misbehaviour or incapacity exclude serving High Court judge appointees under Article 217</h1> These rules prescribe their applicability to the President, Judicial Member and Technical Members of the National Company Law Tribunal, and to the Chairperson, Judicial Members and Technical Members of the National Company Law Appellate Tribunal appointed before commencement of Part XIV of Chapter VI of the Finance Act, 2017, thereby defining the persons subject to the procedure for investigation of misbehaviour or incapacity. They expressly exclude any sitting High Court judge appointed as Chairperson, President or Member of the Tribunal or Appellate Tribunal, who continues to be governed by Article 217 of the Constitution until the period for which the person would have held the office of High Court judge, thereby keeping such appointees outside the rules during that period.
