Dispute resolution: Alternative Investment Funds must use mediation, conciliation or arbitration under Board specified procedures, protecting trust assets. Regulation 25 mandates that all claims, differences or disputes between investors and the AIF or its Manager arising from their securities market activities be submitted to a dispute resolution mechanism including mediation, conciliation and/or arbitration in accordance with procedures specified by the Board. If the AIF is a trust, losses, damages or expenses incurred by the Manager or its officers, including those for resolving investor disputes, must not be paid from trust property.
