Corporate Applicant Must File Insolvency Application Under Section 10 Using Form 6, Serve Copy to Board First.
A corporate applicant must file an application to initiate the corporate insolvency resolution process against a corporate debtor under section 10 of the Insolvency and Bankruptcy Code, using Form 6. This application should include the necessary documents as specified in the Insolvency and Bankruptcy Board of India Regulations, 2016. Before filing with the Adjudicating Authority, the applicant must serve a copy of the application to the Board through registered post, speed post, hand delivery, or electronic means. This requirement was updated in September 2020, replacing the previous mandate to dispatch the application to the corporate debtor's registered office.
