CBEC Amends Project Imports Regulations: Redefines 'Industrial Plants,' Clarifies 'Sponsoring Authority,' and Specifies 'Substantial Expansion' Criteria
The Central Board of Excise and Customs has amended the Project Imports Regulations, 1986, under Notification No. 153/95-Cus dated October 27, 1995. The amendments redefine 'industrial plants' to exclude service-oriented establishments and specify 'sponsoring authority' as the relevant authority listed in an annexed table. The term 'substantial expansion' is defined as an increase in installed capacity by at least 25%. The amendments also replace references to 'concerned Administrative Ministry or Department' with 'concerned sponsoring authority' in regulations 5 and 6. A table is added, listing sponsoring authorities for different types of plants and projects.
