      Summary: Upon effectiveness of an approved amalgamation scheme the amalgamating company ceases to exist and its assets and liabilities vest in the transferee; consequently tax liabilities transfer to the transferee and the transferor cannot be validly assessed after the effective date. Assessments or notices issued in the name of a non existing transferor constitute a jurisdictional defect and substantive illegality rather than a mere procedural irregularity. Administrative records must be updated to substitute the transferee and taxpayers should notify the department to avoid invalid proceedings and litigation.

      Summary: Under the QRMP scheme the portal now auto-populates quarterly Form GSTR-3B liabilities from optional IFF filings for Months 1 and 2 and from Form GSTR-1 for Month 3. Nil filing of quarterly GSTR-1 is enabled via SMS for QRMP taxpayers, subject to exceptions where IFF invoices are saved but not submitted or where IFF is in submitted but not filed status. If registration cancellation is effective after the first day of a quarter, the taxpayer must file GSTR-1 for the entire quarter as the last applicable return.

      Waiver of penalty for noncompliance of the provisions of Noti- No-14-2020-ST regarding QR Code
      Summary: The Government waives the amount of penalty payable by any registered person for non compliance with the QR code requirements of Notification No. 14/2020 State Tax for the period specified in the notification; the waiver applies to penalty amounts under the relevant penalty provision and is issued under statutory executive power on the recommendations of the GST Council, superseding an earlier state notification except as to prior acts or omissions.

      Gujarat Goods and Services Tax (Fifth Amendment) Rules, 2021
      Summary: Amendment extends a compliance cut off in rule 26, requires cumulative application of the specified condition for April, May and June 2021 with FORM GSTR 3B for June (or quarter) to be furnished with cumulative input tax credit adjustments, and permits furnishing May 2021 details via Invoice Furnishing Facility (IFF) during a prescribed window in June 2021.

      Summary: The notification inserts a proviso waiving the portion of the total late fee payable under section 47 for failure to furnish FORM GSTR-4 by the due date for financial year 2021-22 onwards: the portion exceeding two hundred and fifty rupees where the State tax payable is nil, and the portion exceeding one thousand rupees for other registered persons.

      Waiver of late fees of GSTR-3B for March to May 21, conditional waiver for July 17 to April 21 and rationalize fee for June 21 onwards
      Summary: The notification provides class-specific waiver and rationalisation of late fees for delayed FORM GSTR-3B filings: conditional retrospective waiver for returns due July 2017-April 2021 if filed within the June-August 2021 window, with a lower waiver threshold where central tax is nil; and fixed nominal waiver amounts for returns from June 2021 onwards for nil-State-tax filers and for taxpayers in specified turnover tiers. The amendment is effective from 1 June 2021 under section 128.

      Lowering of interest rate for March to May 2021 amending Notification No 13/2017-State Tax
      Summary: Amendment to Notification No. 13/2017-State Tax revises the proviso language, changes the "Tax period" heading to "Month/Quarter," and substitutes table entries setting staged interest rates for late GST payments for March-May 2021. The table differentiates taxpayers by aggregate turnover and return-filing category, prescribing initial lower or nil interest periods from the due date followed by higher rates thereafter. The notification takes effect from 18th May, 2021.

      Summary: The Jammu and Kashmir reimbursement of State Taxes scheme (SRO 134 of 2019), which provided budgetary tax reimbursement to manufacturing units undertaking substantial expansion or new projects meeting an investment threshold of rupees fifty crore or more, is withdrawn by S.O. 240 dated 16 July 2021, with effect from 01.04.2021, terminating the specified tax reimbursement relief.

      Withdrawn of SRO 431 dated 25-09-2018
      Summary: Withdrawal of the scheme providing budgetary support by reimbursement of Integrated Goods and Services Tax (IGST) to manufacturing units is notified. The scheme originally notified by SRO 431 dated 25-09-2018 for promotion of small, medium and large scale industries is declared withdrawn, with a specified prospective effective date for cessation of reimbursements. The notification is issued by the Finance Department and identifies the affected financial mechanism as IGST reimbursement under the cited scheme.

      Summary: Extension of compliance timelines granted to debenture trustees for specified reporting, certification and disclosure obligations due to Covid-19 disruptions. Covered submissions include Asset Cover Certificate, statements of value of pledged securities and DSRA, guarantor net worth and financial certificates, and valuation and title search reports. The extension also applies to website disclosures such as monitoring of asset cover and quarterly compliance reports, utilization certificates, status of covenant breaches and trustee actions, and maintenance of trustee-supervised accounts. The relaxations are issued under SEBI's regulatory powers to protect investor interests and regulate the securities market.

      Summary: SEBI prescribes a framework mandating daily disaggregated reporting of client collateral by TMs to CMs and by CMs to SEs/CCs, client-accessible portals, strict allocation procedures with CM/CC validations, and rules that allocated collateral plus securities re-pledged are used to meet client margins in a prescribed blocking order. CMs must maintain at least 50% cash-equivalents at the CM level, permit allocation changes subject to adequacy, and follow a four-stage default management process (settlement, portability/return, close-out/provisional appropriation, final attribution) with the CC default waterfall as fallback.

      Clarification regarding applicability of IGST on repair cost, insurance and freight, on goods re-imported after being exported for repairs, on the recommendations of the GST Council made in its 43rd meeting
      Summary: Re-imports of goods exported for repair are subject to IGST and compensation cess calculated on the fair cost of repairs, including materials, insurance and freight (both ways), rather than on the full value of the goods. The GST Council affirmed this treatment and recommended a clarificatory amendment after a tribunal decision suggesting IGST exemption; the notifications were amended to remove doubt and implement the Council's position.
