Constitutional Amendment Creating National Judicial Appointments Commission for Judge Selection Replaced Collegium System
The Constitution (99th Amendment) Act, 2014 established the National Judicial Appointments Commission (NJAC) through Articles 124A, 124B, and 124C. The NJAC would comprise the Chief Justice of India as Chairperson, two senior Supreme Court judges, the Law Minister, and two eminent persons nominated by a committee including the Prime Minister. The Commission's functions included recommending appointments of judges to the Supreme Court and High Courts, recommending transfers of High Court judges, and ensuring nominees possessed ability and integrity. Parliament was empowered to regulate appointment procedures. The Amendment was later declared unconstitutional by the Supreme Court.
