National Judicial Appointments Commission Amendment Struck Down as Unconstitutional by Supreme Court in 2015
The 99th Amendment Act, 2014 sought to modify Article 127(1) of the Constitution by replacing 'the Chief Justice of India may, with the previous consent of the President' with 'the National Judicial Appointments Commission on a reference made to it by the Chief Justice of India, may with the previous consent of the President.' This amendment came into force on April 13, 2015, but was subsequently declared unconstitutional by the Supreme Court in 2015, effectively nullifying the proposed change to the appointment mechanism.
