<h1>Supreme Court Upholds States' Power to Maintain Separate Backward Classes Lists Under 105th Constitutional Amendment</h1> The 105th Constitutional Amendment modifies Article 342A to clarify that the President's power to specify socially and educationally backward classes applies specifically to the 'Central List' maintained for Central Government purposes. The amendment adds an Explanation defining 'Central List' and inserts clause (3) which explicitly empowers States and Union Territories to prepare and maintain their own lists of socially and educationally backward classes that may differ from the Central List, notwithstanding the provisions in clauses (1) and (2). This amendment came into force on August 15, 2021.
