Personal Guarantors' Bankruptcy Applications to Follow Insolvency Rules, Submit Electronically or via Scanned Documents
Applications for the bankruptcy process for personal guarantors to corporate debtors must be filed with the Adjudicating Authority under the Insolvency and Bankruptcy Rules, 2019. Until specific procedural rules are notified, applications are handled according to certain rules from the National Company Law Tribunal Rules, 2016, or the Debt Recovery Tribunal Rules, 1993, as applicable. Applications and documents should be submitted electronically when possible, but if not, they can be provided in a scanned format on a data storage device acceptable to the Adjudicating Authority.
