Supreme Court Upholds 10% Reservation for Economically Weaker Sections Under 103rd Constitutional Amendment
The 103rd Constitutional Amendment adds clause (6) to Article 15, allowing the State to make special provisions for economically weaker sections (EWS) of citizens other than those already covered in clauses (4) and (5). These provisions include reservations in educational institutions, including private ones (except minority institutions), capped at 10% beyond existing reservations. The amendment clarifies that 'economically weaker sections' will be defined by the State based on family income and other economic disadvantage indicators. This amendment came into force on January 14, 2019.
