Safeguard investigation procedures require public notice, information exchange, and written submissions to determine serious injury. The Director General must issue a public notice when initiating a safeguard investigation specifying the product, initiation date, factual summary, reasons, contact for representations and response time-limits; copies and the application are to be forwarded to central ministries, concerned trade associations or known exporters, the Government of the Republic of Korea and other interested parties. The Director General may require specified information from exporters, producers and the foreign government, admit submissions from industrial users and consumer organisations, allow oral presentations subject to written follow-up, share evidence among parties, and, where necessary, base findings on facts available if cooperation is withheld.
