Bilateral safeguard measure can suspend tariff reductions or raise duties within MFN limits, subject to domestic safeguard precedence. On the Director General's recommendation, the Central Government may amend Customs notifications to suspend tariff reductions or increase customs duty for originating goods to prevent or remedy serious injury, capped by the lesser MFN applied rate at the time of the measure and the MFN rate before the Trade Agreement. Bilateral safeguards cannot coexist with domestic safeguard action under the Customs Tariff Act; existing bilateral measures must be terminated before domestic action, provisional measures must be withdrawn within thirty days if final findings do not recommend measures, and duties revert to the would-be rate upon termination.
