Mediation requires the mediator to act independently, neutrally and impartially to assist parties toward an amicable settlement while protecting voluntariness, confidentiality and self-determination and observing prescribed professional and ethical standards. The mediator may manage the process-including separate or joint meetings-to ensure orderly, timely conduct and is not bound by the Code of Civil Procedure or the Indian Evidence Act; the mediator, with parties' consent, determines the language(s) of the mediation.
