      Bihar Goods and Services Tax (Second Amendment) Rules, 2024
      Summary: The notification amends Bihar GST Rules to insert references to section 74A alongside sections 73 and 74, prescribes a 30 day period for recipient issued invoices under Rule 47A, requires timely filing of FORM GSTR-7 by the tenth day following the month, omits specified sub-rules affecting refund-linked ITC calculations, and introduces Rule 164 establishing electronic procedures (FORM GST SPL 01/02/03/04/05/06/07/08) for applications for waiver of interest or penalty under section 128A, with payment, documentation, notice, reply, and deemed approval timelines and related modifications to multiple forms and pre-deposit limits.

      Notifies the respective date by which payment for the tax, as per the notice, statement, or order, must be made to qualify for a waiver of interest and penalties under Section 128A of the BGST Act
      Summary: Notifies payment deadlines for waiver of interest and penalties under Section 128A of the Bihar GST Act: registered persons with a notice, statement, or order may make payment up to 31.03.2025 to qualify for waiver; where tax is re-determined following appellate direction, payment must be made within six months from issuance of the re-determination order. Notification effective 1 November 2024.

      Notifies the special procedure for rectification of for Input Tax Credit Orders issued under Section 73, 74, 107, 108 which confirming demand for wrong availment of input tax credit
      Summary: Notification prescribes a special rectification procedure for registered persons to apply electronically within the specified period, using the Annexure A proforma, where orders confirming demand for wrong availment of Input Tax Credit (contravening section 16(4)) are now eligible under later sub sections; the original ordering authority shall decide and issue a rectified order within three months and upload summaries in FORM GST DRC 08 or FORM GST APL 04 as applicable, with natural justice to be observed where rectification adversely affects the applicant.

      TRADE CIRCULAR No. 27/2024 - dated 16-12-2024
      Clarifications regarding applicability of GST on certain services.
      Summary: Affiliation services by universities to colleges are taxable at 18%; affiliation by boards to schools is taxable but exempt for government schools, with GST liabilities for affiliations to all schools regularized on an 'as is where is' basis for the specified prior period. DGCA approved flying training courses with mandated completion certificates are exempt as educational services. Helicopter passenger seat share transport is subject to a lower notified rate and regularized for the prior period while charter operations remain taxable. Ancillary services provided by GTAs in the course of road transport constitute a composite supply of transport of goods.

      TRADE CIRCULAR No. 28/2024 - dated 16-12-2024
      Clarification regarding GST rates & classification (goods) based on the recommendations of the GST Council in its 54th meeting held on 9th September, 2024, at New Delhi.
      Summary: Extruded or expanded savoury or salted snack products manufactured by extrusion and classifiable under HS 1905 90 30 attract 12% GST from 10.10.2024 (past periods liable at 18%), while un fried or un cooked extruded snack pellets remain at 5%. Roof Mounted Package Unit air conditioning machines for railways are classified under HS 8415 and attract 28% GST. Two wheeler seats are classifiable under the two wheeler parts heading and attract 28% GST. Car seat assemblies, previously at 18% under HS 9401, are charged 28% from 10.10.2024 prospectively.

      Clarification on Insurance Amount and Bond Value for CCSPs and validity of Bond for AEO-LO - reg.
      Summary: CCSPs must maintain insurance equal to the average value of goods likely to be stored in the customs area for a five day period based on projected capacity, with the Commissioner entitled to specify amounts considering goods already insured by importers or exporters. Custodian bond exposure for imported and exported goods is reduced to cover five days of storage rather than the previous ten. Approval and custodian bond validity for AEO LO CCSPs continue for the duration of their AEO authorization unless suspended or revoked.

The module also handles online transfer requests across ownership and warehouse-change scenarios with validation of parties, reconciliation of quantity and value, and requirement of the warehousing (triple duty) bond. Scanned monthly returns may be uploaded and web-form filing will follow; prescribed security must continue to be furnished at the port of import alongside the warehousing bond.
