Combat Infringing Imports; ARTS Enhances Monitoring</h1> India, as a WTO member, enforces Intellectual Property Rights (IPR) through various legal frameworks, including the Copyright Act, Trade Marks Act, Patents Act, Designs Act, and Geographical Indications Act. The Customs Act empowers the government to prohibit imports infringing IPRs. Notification No. 51/2010-Cus. prohibits such imports, excluding goods in transit. The IPR (Imported Goods) Enforcement Rules, 2007, outline procedures for Customs and right holders to manage infringements. Parallel imports are allowed under certain conditions for patents and trademarks but not for designs or geographical indications. The Automated Recordation & Targeting System (ARTS) aids in monitoring and enforcing IPRs at customs.
