of Nature of Duty Paid by 100% Export Oriented Units (EOU) - The CESTAT held that while the measure adopted for computing duty paid by 100% EOUs may be based on customs duties, the nature of the duty itself is Excise duty. Therefore, the appellants were entitled to avail CENVAT credit on the duty paid by 100% EOUs under Sl. No. 4 of Notification No. 23/2003-CE. - The tribunal held in favor of the appellants, allowing their appeal and directing the admissibility of CENVAT credit on the duty paid by 100% EOUs as Excise duty.
