Issues: Whether soap noodles cleared by the assessee were "soap in any form" and therefore eligible as the final product for money credit under the relevant notifications, and whether the denial of credit and consequential penalty were sustainable.
Analysis: The expression "final product" in the notifications was expressly identified as "soap", so the real question was whether soap noodles fell within the scope of soap. The tariff entry for Heading 34.01 covered "soap in any form", and the assessee's product, in noodle form, was treated by the Department as soap under the approved classification. The factual position that the goods were manufactured as soap noodles and the processes leading to soap were carried out in the assessee's factory supported the claim for credit. The reasoning was reinforced by the view that the form or shape of the product did not change its essential character where the entry was broad enough to include soap in any form, and by the earlier judicial view relied upon on the same product and notifications.
Conclusion: Soap noodles were held to fall within the expression "soap" and were entitled to the benefit of the money credit notifications. The denial of credit and the penalty were not sustainable.
Ratio Decidendi: Where a tariff entry and notification cover "soap in any form" and the product is accepted as soap in noodle form, the benefit of the notification cannot be denied merely because the goods are in an intermediate-looking shape or are later subjected to further processing.
