Issues: Whether MODVAT credit was admissible on regulators used with ceiling fans.
Analysis: Regulators fitted externally to ceiling fans were held to be indispensable parts of the fans. The decisive test was whether the fan could be marketed without the regulator, not whether the fan could mechanically operate without it. Since ceiling fans were cleared from the factory gate only with regulators, the regulators were treated as components used in relation to the manufacture of the final product.
Conclusion: MODVAT credit on regulators for ceiling fans was admissible and the appeal was allowed.
