India's 40th Amendment: Union Gains Control Over Ocean Resources and Minerals Within Territorial Waters and EEZ.
Article 297 of the Constitution was replaced by the Constitution (40th Amendment) Act, 1976. The new provision states that all valuable resources, including lands and minerals beneath the ocean within India's territorial waters, continental shelf, and exclusive economic zone, are to be vested in the Union for its purposes. Additionally, all other resources within the exclusive economic zone are also to be held by the Union. The boundaries of these maritime zones will be determined by laws enacted by Parliament.
