<h1>Supreme Court Can Decide Pending Cases Under Omitted Article 131-A or Return Them to High Court Post-1977 Amendment.</h1> Article 131-A of the Constitution is omitted by the Constitution (43rd Amendment) Act, 1977. Despite this omission, if any reference made by a High Court under Article 131-A is pending before the Supreme Court at the commencement of this Act, the Supreme Court has the discretion to either proceed with the case as if Article 131-A still exists or return the case to the High Court for resolution as if Article 131-A had been omitted starting from February 1, 1977.
