Customs penalties: breach of customs laws may attract civil, administrative and criminal sanctions affecting preferential tariff entitlement. Each Party must maintain measures providing for civil, administrative, and, where appropriate, criminal sanctions for violations of customs laws governing tariff classification, customs valuation, rules of origin, and entitlement to preferential tariff treatment, without prejudice to the application of existing national legislation or other laws applicable to importers, exporters, producers, manufacturers, or approved exporters.
