SEBI can issue directions for regulation breaches without a hearing, per amended Regulation 26 of 2009 Delisting Rules.
Regulation 26 of the Securities and Exchange Board of India (Delisting of Equity Shares) Regulations, 2009, empowers the Board to issue directions in cases of regulation violations to protect investors and the securities market. This authority is exercised without affecting the provisions of the Act or the Securities Contracts (Regulation) Act, 1956. A proviso requiring the Board to provide an opportunity for a hearing to the concerned party before or after passing such orders was omitted by an amendment in 2018.
