of <h1>New Amendment to Companies Penalty Rules: Pending Cases Follow Old Rules, Sections 454 & 469, Companies Act 2013.</h1> The Ministry of Corporate Affairs has issued the Companies (Adjudication of Penalties) Second Amendment Rules, 2024, under the authority of sections 454 and 469 of the Companies Act, 2013. Effective upon publication in the official gazette, the amendment modifies the Companies (Adjudication of Penalties) Rules, 2014. It introduces a proviso to sub-rule (1) of rule 3A, stating that proceedings already pending before the Adjudicating Officer or Regional Director at the time of the amendment's commencement will continue under the rules as they existed before the amendment.
