MCA Updates IEPF Rules: Legal Heir Certificates, Enhanced Financial Limits, and New Provisions for Foreign Nationals.
The Ministry of Corporate Affairs has issued the Investor Education and Protection Fund Authority (Accounting, Audit, Transfer and Refund) Second Amendment Rules, 2024, effective upon publication in the Official Gazette. Key amendments include replacing 'shares' with 'securities' in relevant sections, allowing legal heir certificates issued by revenue authorities for securities transmission, and requiring notarized indemnity bonds and no objection certificates from non-claimants. The value of securities must be quantified based on market prices or face value. The financial limit for certain processes is increased from Rs. 5,00,000 to Rs. 15,00,000. Additional provisions address foreign nationals and special contingency insurance policies.
