      Summary: Entry taxes levied by States as non discriminatory fiscal measures do not violate the constitutional guarantee of freedom of trade; freedom of trade does not mean freedom from taxation. Only taxes that are discriminatory in a protectionist or hostile sense are prohibited, and the compensatory tax doctrine is rejected.       Summary: The amendment revises rule 114B to treat cash deposits into banks and Post Office accounts exceeding fifty thousand rupees in a day or aggregating over two lakh fifty thousand rupees during 09 November 2016 to 30 December 2016 as reportable, and inserts in rule 114E a reporting obligation for deposits in that period aggregating to twelve lakh fifty thousand rupees or more in current accounts or two lakh fifty thousand rupees or more in other accounts, to be reported by banks, qualifying co-operative banks and the Post Master General by 31 January 2017.

      Filling of online return for second quarter of 2016-17- extension of period thereof
      Summary: Extension of the deadline for filing second-quarter VAT returns for 2016-17 is granted under Rule 49A, requiring submission of online or hard-copy returns in Forms DVAT-16, DVAT-17 and DVAT-48 with requisite annexures by 21/11/2016. Tax payment obligations remain unchanged and must be discharged as usual. Dealers filing returns with a digital signature need not submit the hard copy of the return/Form DVAT-56.

      Deferred payment of Customs duty -reg.
      Summary: Deferred payment of customs duty is permitted for AEO (Tier-Two) and AEO (Tier-Three) importers who obtain ICEGATE login and nominate a nodal person to authenticate transactions via OTP; eligible importers must intimate the Principal Commissioner/Commissioner of Customs (or AEO Programme Manager with copy) and mark flag "D" in the Bill of Entry for deferred payment. Clearance under deferred payment requires nodal authentication. Due dates follow the Deferred Payment Rules, importers may pay selected challans anytime before the due date, and port-wise reports are available in ICES for monitoring.

      Summary: Guidance states Salwar-Kameez, dupatta sets and Choli-Ghagra/lehenga-choli do not qualify as suits unless Chapter Note 3 criteria-identical shell fabric in construction, colour/shade and composition and the upper being a jacket and lower a trouser/short/skirt-are satisfied; otherwise garments must be classified individually (kameez/kurta as dress, salwar/pyjama as trouser) and analogous treatment applies to knitted headings, with existing export clearance procedures unchanged.

      Online Transmission and Processing of Chapter 3 Reward Scheme License/Scrips (SEIS) issued by the DGFT -reg.
      Summary: SEIS scrips will be transmitted from the issuing authority to Customs and automatically integrated into the ICES database, removing the need for manual entry at the port; a one-time physical verification at the port is required before use. Manual debits effected prior to integration or verification are permitted but must be recorded in the EDI ledger and on the hard copy of the scrip, and supporting documents should be presented to the departmental officer for entry within ten days of the notice.

      Summary: Customs will normally accept Export Obligation Discharge Certificates issued under EPCG in terms of FTP/HBP without repeating DGFT's block-wise verification, subject to random detailed checks of a limited number of cases, verification prompted by specific intelligence, endorsement by Regional Authorities, and mandatory genuineness checks of non-EDI shipping bills. Selection for detailed checks will be made by the Joint/Additional Commissioner, with the exporter informed on the date of selection via official email.

      Summary: Procedures require passengers or authorised CHAs to submit a duly completed Baggage Declaration Form with supporting documents to the Superintendent of Customs for scrutiny and signature, then present the BDF to the designated EDI service centre for submission into ICES 1.5. A Preventive Officer examines goods and uploads an Examination Report; the Superintendent verifies assessment and either assesses the BDF or forwards it to AC/DC UB Centre where Transfer of Residence is claimed, baggage value exceeds the threshold, or imports appear prohibited. After assessment, payment of duties/fines is made and Out of Charge is endorsed; CFS gate pass and demurrage/handling payments complete delivery.

      Issuance of Manual Cheque for Drawback in case Amount Not Deposited in Exporter's Account due to errors- reg.
      Summary: When SBI returns drawback amounts due to exporter account discrepancies, exporters must submit a banker-attested request or authority letter (original retained) stating the exact reason and a banker's confirmation of non-acceptance; reasons and corrections will be endorsed on the exporter's copy. The Assistant/Deputy Commissioner (Drawback) will bundle authenticated cases and issue a combined manual cheque to the bank for disbursement.

      Procedure for transhipment of imported goods to SEZ Units -Reg.
      Summary: Integration of SEZ Online with Customs EDI mandates automatic IGM data transfer to Bills of Entry; ICES will generate a Transhipment Permit with a TP number on approval, endorse container particulars, and require an Equipment Interchange Receipt and inspector verification of seal and container numbers before release. Manual quintuplicate endorsements and Transhipment Bonds are dispensed with. Release and warehousing events are communicated electronically between ICES and SEZ Online, and on receipt of Goods Receipt messages ICES will close IGM lines for SEZ cargo.

      Summary: Clarifies that interest for delayed refunds under the Customs framework applies to duty and drawback refunds but is not payable on refunds of deposits such as security deposits or project import deposits; reiterates that refund claims must be finalised promptly, normally settled at the Assistant Commissioner level, with speedy pre audit and cheque issuance.

      Summary: A Document Management System at ICD Mulund will store Bills of Entry, Shipping Bills and related documents electronically and physically; M/s Newgen Software Technology Ltd implemented the system and it began functioning on 18.10.2016. The Service Centre will collect a docket charge via coupons, issuing two coupon sets (normal documentation and DMS). Stakeholders must attach the EDI copy of the coupon to Bills of Entry and Shipping Bills when handing over dossiers after LEO/Out Charge; this is mandatory for all dockets.

Further manual debits should not be made; any manual debit made prior to integration or verification must be recorded in the EDI ledger and on the hardcopy scrip and brought to the concerned officer for entry on the system within ten days. Report implementation issues to the System Manager.

      Rebate of State Levies on Export of Garments -Implementation by CBEC reg.
      Summary: ROSL establishes an opt in, item level rebate administered by CBEC alongside Duty Drawback for garments (Chapters 61/62) from specified export dates, with average rebate rates and per unit caps under two schedules. Exporters must declare eligibility, not claim other refunds, and select an EDI scheme code to claim. Rebate is calculated on FOB value, paid subject to Ministry of Textiles budget and EGM filing, and recovery follows Drawback processes with the Textile Commissioner empowered to recover wrongful payments as arrears of land revenue.

      Summary: Refunds of 4% Additional Duty for qualifying importers are now administered under the merged three tier Authorised Economic Operator programme; the ACP pre audit waiver is discontinued and refund claims must be sanctioned within the expedited timeframes prescribed for AEO tiers, with other existing refund provisions remaining applicable.

For Plant Quarantine, the PLC qualifier must include Info_code plus the prescribed Unit Quantity Code; an inspection date must be provided in the Control Table with the specified control type and result codes, user values in control location, control start date as inspection date, and invoice and item numbers set to zero.

      Summary: Importers and CHAs must, under the self-assessment regime, correctly declare the leviability of Anti Dumping Duty in online Bills of Entry; failure to declare or pay applicable ADD detected during examination or audit will attract severe penal action, and any implementation difficulties should be reported to the Commissioner.

      Summary: Special Advanced Authorisation may be combined with AIR drawback: exporters must use the designated export scheme code in the shipping bill, enter Advance Authorisation details in the DEEC table, and apply modified tariff suffixes to indicate Cenvat availed status. Exporters claiming Brand Rate provisional drawback must declare the prescribed identifier followed by the tariff item and marker to enable provisional payment of the Customs portion of the alternative AIRs. The same procedures permit discharge of EPCG obligations in the shipping bill.

      Single Window Project-clearance of food consignments by Customs officers at locations where FSSAI has provided delegation -reg.
      Summary: SWIFT routes integrated Bills of Entry automatically to PGAs for NOCs while allowing concurrent Customs processing. The RMS applies risk-based selectivity so low-risk consignments have PGA NOC requirements waived and are annotated accordingly; Customs must not manually refer these consignments to PGAs except with Assistant/Deputy Commissioner approval. The RMS will also issue documentary, inspection and sampling instructions based on PGA delegations. Importers and brokers must accurately declare end-use and product details in the Integrated Declaration to ensure correct automated processing.
