A Protector Tube shown by supplier material to be 100% PVC falls under the plastic-tube tariff entry rather than the rubber-hose entry; a certificate of origin using the latter classification prevents preferential customs benefit. Brake hose brackets and connectors designed solely or principally for automobile brake systems classify as motor-vehicle parts rather than generic plastic or residuary entries, resulting in differential duty. End-use based customs duty concession for imported lithium-ion cells applies only where the specified manufacture results in a new product with a distinct nature, character, use or name. Bulk drugs and active pharmaceutical ingredients qualify as drugs and medicines where they meet the applicable pharmaceutical definitions, even when imported for examination, testing, clinical research, bioavailability or bioequivalence studies. The entry is not restricted to finished formulations under Chapter 30. Final debt recovery adjudication fixing personal guarantors' joint and several liability for the entire dues prevents them from re-agitating a claim that their guarantees were limited to the market value of mortgaged properties in collateral proceedings under Section 114 of the Code. Guarantee clauses requiring payment on default and permitting enforcement despite unrealisable security operate with mortgage-related provisions, rather than creating a liability cap. A repayment plan requires the prescribed affirmative creditor vote; the Adjudicating Authority cannot substitute its commercial view where that approval is absent. No prejudice or vitiation of the statutory process was established.
Standing to challenge a concluded liquidation sale is not established merely by a prospective bidder's speculative assertion that it might have participated had later conditions been available during the e-auction. A person who neither participated in nor expressed interest in the auction, and is not otherwise affected, lacks a substantive basis to annul the e-auction, letter of intent, or sale certificate. Although costs may deter IBC litigation by strangers, they must remain proportionate; where the challenge did not delay liquidation, excessive costs warrant reduction. The sale remains undisturbed, while costs are reduced to a proportionate amount payable to the Prime Minister's Relief Fund.

Employment-agreement claims for unpaid salary, increments, sales commission and related dues concern a contract of personal service and fall outside the statutory definition of a commercial dispute under the Commercial Courts Act, 2015. Ordinary employer-employee disputes cannot be brought within that definition contrary to the legislative framework. Where such a recovery claim is filed before a Commercial Court, the plaint should be returned for presentation before the appropriate court rather than dismissed, avoiding the need to institute a fresh proceeding and incur further expense.

Documentary evidence supporting the stated lawful purchase of seized gold must be verified and analysed before determining whether it is of foreign origin or smuggled. Acknowledgement of invoices without specific findings on their evidentiary value does not address the defence concerning the gold's source. Failure to examine material purchase evidence renders absolute confiscation and the related penalty determination unsustainable; no conclusion on the merits of the alleged smuggling follows without that assessment.
Additional evidence before the first appellate authority must be considered where necessary for a merits-based decision and fair adjudication.
Rule 46A(4) permits the first appellate authority to admit additional evidence where it is necessary for a merits-based disposal, even if no formal Rule 46A application has been made. Section 250(4) further requires that authority to conduct, or direct the Assessing Officer to conduct, further inquiry where circumstances warrant it. Refusing relevant material solely for want of a formal application and sustaining an unexplained-investment addition without deciding the merits is inconsistent with fair adjudication and natural justice. The matter requires fresh adjudication after adequate opportunity to furnish relevant evidence.
