Reassessment sanction required approval from the prescribed senior authority; approval by Principal Commissioner invalidated the resulting proceedings.
For reassessment initiated after the prescribed three-year period under the pre-1 April 2023 framework, approval for the order under section 148A(d) and notice under section 148 had to be obtained from the Principal Chief Commissioner or Chief Commissioner under section 151(ii). The extension provisions in section 149 could not alter that sanctioning requirement without an express enabling provision. The Finance Act 2023 proviso to section 151 operated prospectively and could not cure prior approval by a Principal Commissioner. Sanction by an incompetent authority rendered the resulting reassessment proceedings unsustainable.
CCPS valuation under the prescribed method cannot be replaced by an alternative method based on later financial losses.
For share-premium taxation, CCPS fall within the valuation framework for unquoted securities other than equity shares. A valuation prepared under the prescribed method cannot be displaced by applying the separate method for unquoted equity shares. DCF valuation must be assessed using facts and financial data available on the valuation date; subsequent losses do not by themselves invalidate it. Standard disclaimers in a valuation report are not independently sufficient to reject the valuation. Issuance of CCPS by a wholly owned subsidiary to its holding company does not, without specific evidence, establish unaccounted income or artificial inflation of share value.
Completed motor vehicle sale arises on delivery with original documents despite unregistered ownership transfer under sale-of-goods principles.
Delivery of a motor vehicle with its original documents can constitute a completed sale where possession and property pass, even if ownership transfer is not registered under motor-vehicle rules. Under the Sale of Goods Act, delivery and payment are concurrent conditions; a retained duplicate key may indicate only a seller's lien, while non-payment engages unpaid-seller remedies. A transaction not made on approval or sale-or-return is not governed by those conditional-sale rules. A delayed complaint after seizure may not justify writ interference with an assessment.
Section 153C jurisdiction requires year-specific incriminating material and recorded satisfaction; notices outside the statutory block period fail.
Section 153C jurisdiction requires seized incriminating material concerning the other person, recorded satisfaction identifying its nexus to each relevant assessment year, and compliance with the statutory block period. For a person other than the searched person, receipt of seized material by the jurisdictional Assessing Officer is the deemed search date. Material received in March 2021 placed Assessment Year 2021-22 at the start of the ten-year block, extending only to Assessment Year 2012-13; notices for Assessment Years 2008-09 to 2011-12 were therefore invalid. The block period does not permit reopening years without year-specific material and corresponding satisfaction.
Search assessment limitation excludes Assessment Year 2014-15 from the extended block, rendering the reassessment notice time-barred.
For a search conducted in Financial Year 2023-24, the extended ten-year assessment block is computed under Explanation 1 to section 153A from the end of the assessment year relevant to the previous year of search. Assessment Year 2024-25 is therefore the first year of that block and Assessment Year 2015-16 its tenth year. Assessment Year 2014-15 falls outside the extended period. The distinct six-year and ten-year computational regimes under sections 149, 152(3), 153A and 153C consequently render reassessment notice for Assessment Year 2014-15 barred by limitation.
Royalty characterisation of restricted live-feed rights fails where no recording, preservation, or future re-telecast rights exist.
Payments for rights limited to live telecast of a sports series, without rights to record, preserve, or re-telecast the feed after the relevant events, do not constitute royalty under Section 9(1)(vi) of the Income-tax Act, 1961. Royalty requires an enduring benefit or exploitation right. Restricted live-feed rights that expire with the events do not confer such enduring rights; therefore, consideration paid to the overseas rights holder is not chargeable to tax as royalty.

Capital-gains reinvestment under sections 82 and 86 raises whether residential-property construction expected to exceed the three-year outer period can qualify where mutual funds are redeemed over four years and paid to a developer in instalments. The issue is whether each redemption may be assessed independently from its date, rather than requiring completion within three years from the first capital gain or first redemption. It also concerns applying the investment cap when gains and consideration arise across multiple years.
Revisionary jurisdiction fails where an assessment adopts a legally possible view on debatable issues governed by precedent.
Revisionary jurisdiction under Section 263 requires an assessment order to be both erroneous and prejudicial to the interests of the Revenue. Where the Assessing Officer adopts a legally possible view on debatable issues, including issues covered by coordinate Tribunal decisions favouring the assessee, the order does not meet that standard. Further examination cannot justify revision when binding Tribunal decisions would not permit a different conclusion; revision on those grounds is therefore unsustainable.

Recorded sales receipts cannot be recast as unexplained cash credits, preventing double taxation despite a valid reassessment.
Reassessment based on information concerning a receipt requires recorded reasons establishing a link between the information and the belief that income escaped assessment. Reasons identifying the alleged accommodation-entry provider, its connection with the payer, the receipt, and its non-reflection in disclosed bank accounts were treated as sufficiently specific, so reassessment remained valid. A receipt recorded as sales and supported by sale particulars, customer confirmations, and undisputed purchase and quantitative details cannot also be assessed as unexplained cash credit. As the sales income and profit element were accepted, a further addition would result in double taxation; the related commission addition lacked basis.

Section 74 permits enhanced tax determination for wrongly availed or utilised input tax credit only where fraud, wilful misstatement, or suppression of facts to evade tax is established. Wrong or ineligible credit is distinct from substantive credit eligibility and cannot, without evidence of deliberate conduct and intent, amount to suppression. Under historical Explanation 2, suppression required either omitted information legally required in prescribed filings or failure to provide information sought in writing; both operate subject to the statutory evasion requirement. Disclosed reconciliations and portal records materially weaken a bare allegation of non-declaration.
Complex accounts and extensive client-linked expenditure can justify a special audit where verification requires substantial effort.
Special-audit direction under Section 142(2A) was valid because substantial gross receipts, extensive expenditure claimed under several heads for clients, and voluminous vouchers and bills required linkage with clients' business accounts. The accounts were sufficiently complex because verifying the admissibility and correctness of the claimed expenditure required a laborious exercise. The recorded reasons therefore supported the direction, which operated against the assessee.

Classification of low-ethoxylated non-ionic fatty alcohol ethoxylates under Heading 3402 requires satisfaction of the cumulative water test in Chapter Note 3. At the prescribed concentration, temperature, and standing period, the product must both remain a transparent or translucent liquid, or stable emulsion, without phase separation and reduce water surface tension to the stated threshold. Non-ionic character or surface activity alone is insufficient. Where a low-ethoxylated product separates into layers and fails the solubility and stability requirement, Heading 3824 may be considered after exclusion from Heading 3402.
