Notification No. 28650-FIN-CT1-TAX-2/2020/FIN Dated:- 11-10-2021 Orissa SGST
State GST regulatory scope is expanded by adding sub-section (6A) as an alternative reference before sub-section (6B) in the first paragraph of the earlier specified instrument. The amendment, made under the stated statutory power and on Council recommendations, is deemed effective from 24 September 2021 and applies from that stated earlier date.

Capital-gains reinvestment under sections 82 and 86 raises whether residential-property construction expected to exceed the three-year outer period can qualify where mutual funds are redeemed over four years and paid to a developer in instalments. The issue is whether each redemption may be assessed independently from its date, rather than requiring completion within three years from the first capital gain or first redemption. It also concerns applying the investment cap when gains and consideration arise across multiple years.

Revisionary jurisdiction fails where an assessment adopts a legally possible view on debatable issues governed by precedent.
Revisionary jurisdiction under Section 263 requires an assessment order to be both erroneous and prejudicial to the interests of the Revenue. Where the Assessing Officer adopts a legally possible view on debatable issues, including issues covered by coordinate Tribunal decisions favouring the assessee, the order does not meet that standard. Further examination cannot justify revision when binding Tribunal decisions would not permit a different conclusion; revision on those grounds is therefore unsustainable.

Notification No. 28646-FIN-CT1-TAX-2/2020/FIN Dated:- 11-10-2021 Orissa SGST
Specified Odisha SGST service-rate entries remove references to Governmental Authorities and Government Entities, retain Union Territory or Local Authority references, omit listed column 5 entries, and add 12AB alongside 12AA. Intellectual property rights transfers and specified manufacturing, publishing, printing, reproduction and material recovery services are placed at 9%; job work for alcoholic liquor manufacture is inserted at 9%. Admission services are separated between amusement venues and ballet at 9%, and casinos, race clubs and specified sporting events at 14%.

The amendment is deemed effective from 16 October 2020.

Recorded sales receipts cannot be recast as unexplained cash credits, preventing double taxation despite a valid reassessment.
Reassessment based on information concerning a receipt requires recorded reasons establishing a link between the information and the belief that income escaped assessment. Reasons identifying the alleged accommodation-entry provider, its connection with the payer, the receipt, and its non-reflection in disclosed bank accounts were treated as sufficiently specific, so reassessment remained valid. A receipt recorded as sales and supported by sale particulars, customer confirmations, and undisputed purchase and quantitative details cannot also be assessed as unexplained cash credit. As the sales income and profit element were accepted, a further addition would result in double taxation; the related commission addition lacked basis.

Section 74 permits enhanced tax determination for wrongly availed or utilised input tax credit only where fraud, wilful misstatement, or suppression of facts to evade tax is established. Wrong or ineligible credit is distinct from substantive credit eligibility and cannot, without evidence of deliberate conduct and intent, amount to suppression. Under historical Explanation 2, suppression required either omitted information legally required in prescribed filings or failure to provide information sought in writing; both operate subject to the statutory evasion requirement. Disclosed reconciliations and portal records materially weaken a bare allegation of non-declaration.

Complex accounts and extensive client-linked expenditure can justify a special audit where verification requires substantial effort.
Special-audit direction under Section 142(2A) was valid because substantial gross receipts, extensive expenditure claimed under several heads for clients, and voluminous vouchers and bills required linkage with clients' business accounts. The accounts were sufficiently complex because verifying the admissibility and correctness of the claimed expenditure required a laborious exercise. The recorded reasons therefore supported the direction, which operated against the assessee.

Classification of low-ethoxylated non-ionic fatty alcohol ethoxylates under Heading 3402 requires satisfaction of the cumulative water test in Chapter Note 3. At the prescribed concentration, temperature, and standing period, the product must both remain a transparent or translucent liquid, or stable emulsion, without phase separation and reduce water surface tension to the stated threshold. Non-ionic character or surface activity alone is insufficient. Where a low-ethoxylated product separates into layers and fails the solubility and stability requirement, Heading 3824 may be considered after exclusion from Heading 3402.

Notification No. G.O. Ms. No. 10 Dated:- 25-1-2019 Tamil Nadu SGST
Under Tamil Nadu SGST, an erratum corrects the date cited in the opening paragraph of the amendment concerning supplies treated as deemed exports. The reference to 18 January 2019 must be read as 18 October 2017, substituting the October 2017 reference for the January 2019 reference in the deemed-export amendment under the Tamil Nadu SGST framework.

Notification No. 28642-FIN-CT1-TAX-2/2020/FIN Dated:- 11-10-2021 Orissa SGST
Odisha SGST exemption entries now recognise section 12AB registration alongside section 12AA in specified entries, remove references to Governmental Authority or Government Entity in two service descriptions, and retain event coverage when hosted Indian events are rescheduled. Nil-rated treatment covers services connected with the AFC Women's Asia Cup 2022, subject to certification of their direct or indirect event connection, admission rights to those events, and the grant of National Permits for goods carriages operating throughout India or contiguous States.

Customs seizure of an imported car requires recorded reason to believe that it is liable to confiscation. A panchnama restraint cannot replace a lawful seizure order, an undertaking where seized goods remain in custody, or a served non-dealing order where seizure is impracticable. Section 110(2) requires prompt notice under Section 124, subject only to the prescribed extension mechanism. Prolonged effective detention cannot postpone those safeguards. Provisional release under Section 110A applies only to goods lawfully seized and cannot validate an earlier detention without statutory authority.

Net-profit estimation based on an unchanged preceding-year basis favoured the assessee over a higher sales-based estimate.
Net-profit estimation for the relevant assessment year followed the basis sustained for the preceding year, as no distinguishing facts were established. The previously confirmed appellate estimate supported net profit at 0.22% of sales instead of 7%. The unchanged factual position resulted in retention of the lower sales-based estimate, in favour of the assessee.

Dynamic QR Code requirements apply to B2C invoices issued by taxpayers whose aggregate turnover exceeds Rs. 500 crore, including invoices issued to Unique Identity Number holders. A UPI ID in the QR Code need not be accompanied by separate bank-account and IFSC details, and an authorised payment collector's UPI ID may be used. QR Codes may be omitted for specified services supplied to overseas recipients. For over-the-counter sales, a uniquely invoice-linked order ID may substitute for an unavailable invoice number. Where part-payment is received, the QR Code may show only the remaining amount payable.

Transfer-pricing penalty fails where comparable selection differences were disclosed and pricing was determined in good faith.
Explanation 7 to section 271(1)(c) deems a transfer-pricing addition to be concealed income unless the taxpayer proves that the arm's length price was computed under section 92C in good faith and with due diligence. Differing use of current-year or multiple-year data, selection or exclusion of comparables, and choice of profit-level indicator do not by themselves justify penalty where the relevant particulars were disclosed in the transfer-pricing report. Where no material disproves good faith or due diligence, a transfer-pricing adjustment does not warrant concealment penalty.

Repeated notice non-compliance constitutes one default, limiting penalty exposure and directing continued default toward best judgment assessment.
Repeated non-compliance with notices seeking the same information constitutes a single default for penalty purposes, even where no reasonable cause exists. Because the penalty provision is deterrent rather than revenue-raising, successive notices cannot multiply penalties for an unchanged default. Continued non-compliance should instead be addressed through best judgment assessment under section 144. Penalty is therefore confined to a single default, with any excess penalty deleted.
