The CESTAT allowed the appeal and set aside the impugned order concerning the enhancement of value of imported Slack Wax. The Tribunal held that reassessment of the Bills of Entry without adherence to the prescribed Valuation Rules procedure was improper. While the Customs National Import Database (NIDB) provides comprehensive contemporaneous import data useful for verifying declared transaction values, it cannot be used in isolation to disregard invoice values. Specific Bills of Entry data must be furnished to the importer to enable a proper defense, and the particular Valuation Rule invoked for reassessment must be disclosed. Consequently, reliance solely on NIDB data without following procedural safeguards renders the reassessment unsustainable.
