of The High Court held that the penalty imposed on a company cannot be recovered from its former director u/s the Companies Act. The director cannot be held personally liable as there is no provision for such recovery. The director had resigned and filed necessary documents with the Registrar of Companies. The court quashed the order imposing penalty on the director and directed implementation against others, excluding the petitioner. Petition allowed.
