of Dishonour of Cheque - cheque issued as security - Since factum with regard to advancement of loan to the tune of Rs. 1.00 lac stands established on record and same was never repaid, cheque issued as security, if any, could be well presented by the complainant before the bank concerned for encashment. - By now it is well settled that dishonour of cheque issued as security can also attract offence under Section 138 of the Negotiable Instruments Act. - HC
